Terms of Service

By accessing or using BatComments ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access or use the Platform.

You must be at least 13 years old to use BatComments. However, if applicable law in your jurisdiction requires you to be older to lawfully use the Platform without parental consent (such as 16 years of age under certain European or US state laws), you must meet that minimum age requirement.

By registering for an account, you represent and warrant that you meet the applicable age requirements. If we discover that a user is under the legally required age of digital consent, we will terminate their account immediately.

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

You are responsible for safeguarding the login credentials and authentication methods you use to access the Platform. BatComments cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

You retain all of your ownership rights in your content, including posts, comments, text, and images. However, by submitting content to BatComments, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display that content in connection with the Platform.

You are solely responsible for your own content and the consequences of posting or publishing it.

When you delete your account, posts, or media, we do not instantly destroy the data. To prevent accidental data loss, maintain platform security, and investigate potential abuse, deleted or modified data is securely moved to a temporary archive.

We retain this archived data for a strict period of 30 days. After this 30-day window expires, the data is automatically and permanently wiped from our servers and storage systems.

While using BatComments, you agree not to:

• Post content that is illegal, abusive, harassing, defamatory, or highly offensive.
• Upload malware, viruses, or any code of a destructive nature.
• Use automated bots, scrapers, or other unauthorized means to access or collect data from the Platform.
• Attempt to bypass or manipulate our moderation systems, voting mechanisms, or authentication processes.

The BatComments name, logos, and the underlying platform architecture, code, and design are the exclusive intellectual property of BatComments and its independent developers. You may not use, copy, or distribute our intellectual property without prior written permission.

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

The platform is provided on an "AS IS" and "AS AVAILABLE" basis.

In no event shall BatComments, nor its developers, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

These Terms shall be governed and construed in accordance with the laws of Assam, India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
