Overview & Safe Harbor

BatComments operates as an online service provider hosting User-Generated Content (UGC). We respect the intellectual property rights of others and comply with the safe harbor provisions of the Digital Millennium Copyright Act of 1998 ("DMCA").

We will respond expeditiously to valid claims of copyright infringement committed using the BatComments platform. Upon receiving a proper takedown notice, we will remove or disable access to the allegedly infringing material and subject the removed data to our standard 30-day legal retention archive before permanent deletion.

Filing a Takedown Notice

To file a valid DMCA Takedown Notice, you must provide our Designated Agent with the following information in writing:

  • Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed.
  • Identification of the material: Provide the exact URL (link) or a highly specific description of where the allegedly infringing material is located on BatComments.
  • Contact Information: Provide your mailing address, telephone number, and email address.
  • Good Faith Statement: Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  • Perjury Statement: Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  • Signature: Provide your physical or electronic signature.

Filing a Counter-Notice

If you believe that your content was removed (or access to it was disabled) by mistake or misidentification, you may file a Counter-Notice with our Designated Agent. A valid Counter-Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district, or if you are outside the United States, that you consent to jurisdiction in any judicial district in which BatComments may be found.

If a valid Counter-Notice is received, BatComments may send a copy of the Counter-Notice to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, the removed content may be replaced or access to it restored in 10 to 14 business days.

False Claims & Liability

Warning:Under 17 U.S.C. § 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to severe legal consequences and liable for any damages, including costs and attorneys' fees incurred by BatComments or its users.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, BatComments has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

We reserve the right to modify, alter, or update this DMCA Policy at any time. We encourage users to review this page periodically. Continued use of BatComments after any such changes shall constitute your consent to such changes.
